Trainor Glass termination suit dismissed

The class action suit filed by a formed Trainor Glass employee has been dismissed by the bankruptcy judge. Attorneys for Trainor Glass charge that the plaintiff’s WARN Act claim is a pre-petition claim.

The employee class action suit against Trainor Glass Co. was dismissed by the bankruptcy judge hearing the case, according to court documents.
The suit, which was filed by former Trainor employee Katherine McNeel on her own behalf and on behalf of others similarly situated, charged that the company violated the Worker Adjustment and Retraining Notification Act by failing to provide notice of the company’s complete closure.
Attorneys for Trainor Glass charge that the plaintiff’s WARN Act claim is a pre-petition claim that should be addressed in the Claims Administration Process, and not by way of an adversary proceeding, according to court documents.
